CCI Imposes Massive Penalty on HP India for Dictating Bid Prices in Cartelization Scandal​

The Competition Commission of India (CCI) has delivered a significant ruling against HP India, imposing a substantial penalty for engaging in anti-competitive practices within the supply chain of personal system products. The decision highlights serious concerns regarding market manipulation and cartelization by large corporations and their partners.

Penalty Imposed on HP India and Resellers​

Under an order issued on 13.07.2026, the CCI levied a penalty of INR 126.87 crores against HP India. Additionally, five affiliated resellers faced a combined penalty of approximately INR 1.22 crores for their involvement in these anti-competitive practices.

The Commission mandated that both HP India and its five designated resellers cease and desist from any further violation of the Act. This ruling was made under Section 27 of the Competition Act, 2002.

Details of Anti-Competitive Practices​

The proceedings originated from a lesser penalty application filed by HP India itself under Section 46 of the Act. Evidence presented before the Commission revealed that HP India had been actively dictating bid prices to its resellers.

Furthermore, the CCI found evidence of market manipulation related to GeM tenders. HP allegedly withheld necessary authorization to manipulate reseller participation, all in order to benefit the company unfairly, contravening Section 3(3)(d) read with Section 3(1) of the Act.

Collusion Among Resellers and Officials​

The anti-competitive conduct was not limited to HP India. The Commission determined that five specific resellers were acting in collusion with HP India during this period. These firms include Delphi Infosolutions, Digitech Computers, Orbit Techsol, Hind Technocare, and Krishna Computers.

The CCI also found officials from both HP India and the implicated resellers liable under Section 48 of the Act. A monetary penalty was consequently imposed upon the culpable individuals as well.

Market Surveillance Under Competition Commission​

This rigorous action by the CCI underscores the body's commitment to maintaining fair competition within high-stakes markets. The case highlights how market power can be misused when a dominant player controls inputs and authorization processes.
