The proceedings stemmed from an application filed by HP India under Section 46 of the Act, alleging rampant cartelization among its distribution network. Based on the evidence reviewed, the Commission determined that both HP India and a group of its resellers were involved in concerted anti-competitive behavior.The CCI concluded that HP India had played a central role in orchestrating this cartel arrangement amongst the affected distributors. Scope of Penalized Parties and Mandate
Sixteen specific Tier-2 resellers, including Ascent Information, DD Enterprises, Kaypee Enterprises, and Shakti Marketing, were found guilty in connection with the cartelization structure. These firms participated by seeking and submitting support or cover bids in direct contravention of Section 3(3)(d) read with Section 3(1) of the Act.In addition to imposing monetary penalties under Section 48 of the Act, the CCI has issued a strict mandate. HP India and all penalized resellers have been directed to cease and desist immediately from any anti-competitive conduct related to these supplies products.
