NHAI Issues New Circular Reaffiming WPI Linking Factor for Toll Fee Revision
Interise Trust has reported an update concerning the Wholesale Price Index (WPI) linking factor used in calculating user fee rates (Toll) for public funded and BOT concession agreements awarded by the National Highways Authority of India (NHAI).The development follows an earlier intimation regarding a writ petition filed by Highway Operators Association(I) and others, which resulted in an order from the Delhi High Court on October 17, 2025. This court directive directed NHAI to re-examine a previous circular (dated September 13, 2025), which had revised the WPI linking factor for toll computation from 1.641 to 1.561.
In response to this matter, NHAI has issued a new circular dated July 8, 2026. This directive mandates that the linking factor of '1.641' will continue to be followed for the revision of user fees (toll) across all existing Contract or Concession Agreements and all future national highway projects.
The new circular serves as an amendment, superseding the previous September 13, 2025 Circular. This ensures continuity in the determination of toll rates until further amendments are issued under the National Highways Fee (Determination of Rates & Collection) Rules, 2008.
