Brigade Enterprises Ltd has strongly objected to the revocation of the Environmental Clearance (EC) for its residential project, 'Brigade Morgan Heights,' by the State Level Environment Impact Assessment Authority (SEIAA). The company asserts that the cancellation is factually incorrect and legally unsustainable.

The project is located in Perumbakkam Village, Chennai. Brigade contends that the site consists of private patta lands classified as dry lands dating back to 1935, which have been under the continuous possession of current landowners since 1985. The company entered into a Joint Development Agreement (JDA) with the landowner for the property in 2022 and secured EC while issuing public notices in leading newspapers at both the time of securing the EC and signing the JDA, after which no objections were received.

Brigade stated that prior clarification issued by the Environment, Climate Change and Forest Department on October 28, 2025, clarified that the lands are private patta lands and that approvals had been granted based specifically on this classification, noting that final wetland boundaries remained undecided. The company also referenced a ruling from the Madras High Court on February 10, 2026, where it dismissed a Public Interest Litigation (PIL). The High Court concluded that the project lands could not be conclusively designated as wetlands until ground truthing was completed in the Ramsar process, noting that authorities had made no submissions claiming the land was wetland or that approvals should be cancelled during that hearing.

The company highlights that the reason cited for cancellation is based on a generic condition found in all SEIAA-issued ECs: 'the project proponent shall obtain permission from the Wetland Authority if applicable'. Brigade argues this condition is inapplicable because no authority has conclusively declared the lands to be wetlands, including during the PIL heard by the High Court.

The revocation occurred after SEIAA convened a meeting on May 08, 2026, and issued the cancellation order on May 12, 2026. Brigade emphasized that it was not provided with any prior notice, personal hearing, technical discussion, site verification, or an opportunity to submit documentary evidence before the revocation.

Brigade noted that the proposed Ramsar site and its Zone of Influence covers over 11,000 acres in South Chennai, impacting not only the company but also the general public, property owners, developers, and builders across the region. Given these factors, Brigade is appealing the order and exploring all appropriate legal and regulatory remedies available to it.

Brigade Enterprises Limited finished the trading day after shedding 1.03% of its value, settling at ₹554.60. The equity concluded the session with a traded volume of roughly 1.1 million shares.
