US Expresses Concern Over Potential Shipments of EUV Equipment to China​

Commerce Secretary Howard Lutnick reportedly outlined concerns to ASML’s senior leadership that one of its top-of-the-line machines may have entered China. These meetings focused on ASML’s extreme ultraviolet (EUV) lithography systems, which are critical for manufacturers like Taiwan Semiconductor Manufacturing Co. and firms such as Apple Inc.

ASML has consistently refuted these allegations, asserting that none of the sophisticated tools—which are described as being the size of a school bus—are currently in China. A company spokesperson confirmed that ASML talks with all governments and emphatically stated it has never shipped an EUV machine to China.

Multiple senior administration officials claimed to possess evidence indicating that ASML was not acting in good faith, citing exports to China of specialized gear related to the advanced EUV tools. The government officials declined to disclose this proof, stating that the information was too sensitive to release publicly.

ASML Denies Misconduct and Highlights Compliance Efforts​

ASML maintains it is operating with full transparency and adherence to international regulations. The company stated that it recognizes the national security considerations within both U.S. and Dutch export control regulations. Furthermore, ASML pointed out that its tools require constant upkeep from specialized staff and are not produced in limited quantities, complicating unauthorized relocation.

Following a key meeting with Lutnick in April, ASML reportedly entered "crisis mode," creating a document circulated internally in Washington titled “No indication of any ASML EUV System in China.” This internal review noted that out of 314 operating EUV machines globally, none are in China. The firm further explained the specialized procedures required for transport and removal of its sensitive systems.

Geopolitical Tensions and Tech Rivalries Mount​

The dispute places immense pressure on the company amidst an already complex business environment in Beijing. China's lack of access to ASML’s EUV tools remains a critical constraint for Huawei Technologies Co., the Asian country's leading rival to Nvidia Corp.

Senior administration officials raised concerns that ASML might be prioritizing short-term profits over national security, bringing up prior legal shipments of gear before certain Deep Ultraviolet (DUV) controls were officially in place. These calls echo earlier frustration experienced under the Biden administration regarding rapid acceleration of soon-to-be-banned equipment.

These tensions are unfolding against a backdrop of wider legislative risk. Congress recently passed a bipartisan bill that aims to toughen curbs on companies including ASML and Japan's Tokyo Electron Ltd., seeking parity in restrictions across China. This legislation calls for an effective ban on shipments of all types of immersion DUV tools from ASML, which could dramatically limit the Dutch firm’s access to the Chinese market.
