Chilean Tax Authority Upholds Position in Dispute Regarding Tega Industries Chile Loss Carry Forward

Chilean Tax Authority Upholds Position in Dispute Regarding Tega Industries Chile Loss Carry Forward

Tega Industries Ltd has reported that its subsidiary, Tega Industries Chile SpA (Tega Chile), received a ruling from the First Tax and Customs Tribunal in Santiago Metropolitan Region, Chile. The Tribunal dismissed Tega Chile's appeal concerning an accumulated tax loss carry forward, upholding the position taken by the Chilean Department of Revenue.

The dispute related to a claim filed by Tega Chile for the Tax Year 2020. The Servicio de Impuestos Internos (SII) initially disallowed a portion of the tax loss carry forward on the grounds that insufficient supporting documentation had been provided. Although Tega Chile's Voluntary Administrative Reposition (RAV) was partially accepted, the remaining claim remained disputed.

After filing a judicial appeal against the partial rejection with the First Tax and Customs Tribunal, the appeal was dismissed. The Tribunal confirmed the findings of the SII regarding the disputed tax loss.

The matter involved no allegations of violation or contravention against Tega Chile. Instead, it concerned the allowability of a portion of the accumulated tax loss carry forward, which the Chilean tax authorities disallowed primarily due to inadequate supporting documentation for the claim.

Financial details relating to the disputed carry forward loss and exposure are summarized below:

DetailAmount
Disputed Tax Loss Carry ForwardApproximately CLP 3.17 billion (approximately INR 32.32 crores)
Estimated Tax ExposureApproximately CLP 856 million (approximately INR 8.73 crores)

Tega Chile informed the Company about the outcome on July 14, 2026. The Company stated that it does not foresee any material impact resulting from this matter on its financial or operational activities. Tega Chile is currently evaluating all available options, including filing a further appeal against the ruling.
