The investigation commenced in September 2025, prompted by allegations from the Alliance for American Solar Manufacturing and Trade (AASMT). AASMT, a coalition of domestic solar producers, accused Waaree of circumventing anti-dumping and countervailing duties. The core allegation was that the company mislabeled the origin of its solar cells after importing them from China and other Southeast Asian countries.

CBP's investigation period covers shipments from January 1, 2021, through June 23, 2026. During this timeframe (2021 to 2025), Waaree reported India as the country of origin for imports into the U.S. in its entry summary with CBP.

Misrepresentation Uncovers Hidden Violations​

The investigation report dated June 23 concluded that the company misrepresented the origin of certain historical shipments to the U.S. While Waaree's official statement noted that it was cleared of allegations regarding the use of Chinese-made solar cells, the probe revealed a different issue. The CBP found that the modules were declared as originating from India when they were actually sourced from Vietnam or Malaysia.

The CBP report stated emphatically that information concerning four years of misrepresenting the country of origin is not mere error but a material and false act. Substantial evidence showed Waaree entered covered merchandise through evasion, thereby avoiding applicable AD/CVD deposits or other necessary security requirements.

Legal Ramifications and Future Actions​

The US Department of Commerce had previously issued preliminary countervailing duties (CVD) against solar exports from Malaysia and Vietnam on October 1, 2024. A final determination of these duties was reached in April 2025. CBP noted that its current determination is limited to a specific subset of certain historical import entries.

Waaree responded by stating that the company is currently evaluating all available legal remedies with its U.S. trade counsel. The company maintains that it has the right to seek a de novo administrative review, followed by judicial review before the U.S. Court of International Trade, as permitted under applicable U.S. law.
