Developer's Appeal Filed Against High Court Order on DCM Limited Land Dispute​

DCM Limited is facing legal challenges from GCD Prime regarding a Joint Development Agreement (JDA) concerning land in Hisar, Haryana. The developer has filed an appeal before the Delhi High Court following the court's dismissal of an interim petition related to the dispute.

The matter stems from a partnership agreement executed between DCM and GCD Prime for the development of approximately 68.35 acres of land near Mela Ground in Hisar under the Deen Dayal Jan Awas Yojana (DDJAY) policy. The collaboration, which began with a Term Sheet on August 1, 2022, led to the execution of the JDA on November 11, 2022.

The dispute intensified when DCM’s license for the affordable residential plotted colony was suspended by the Director General, Town and Country Planning, Haryana, in April 2023 due to alleged unauthorized sale or illegal change of land use. Despite DCM making efforts to support the developer in obtaining the suspension revocation from state authorities, the issue remained pending for more than two years.

On November 1, 2025, the company's Board approved and issued a Notice of Forfeiture and Termination to GCD Prime based on the failure and delay in resolving the license status.

The conflict subsequently led to legal action. Following DCM’s termination notice, GCD Prime initiated proceedings under Section 9 of the Arbitration and Conciliation Act, 1996, seeking various interim reliefs from the Delhi High Court. The court pronounced an order on July 28, 2026, dismissing the developer's petition.

In response to this ruling, DCM Limited received notice via email on August 7, 2026, detailing GCD Prime’s appeal filed before the Hon'ble High Court of Delhi, seeking to set aside the July 28, 2026 order.

Key aspects of the dispute include:

• The land size is approximately 68.35 acres in Hisar, Haryana.
• GCD Prime and DCM shared development rights, with the company entitled to 55% of the net sale revenue and GCD Prime entitled to 45%.
• The JDA stipulated that all decisions regarding the project’s development and marketing would be jointly taken by both parties.

This ongoing legal contention focuses on the status of the JDA and the rights surrounding the land, following DCM's termination action and subsequent judicial proceedings.
