
Asian Hotels Wins Interim Ruling in Delhi High Court Over Hotel Property Deed Release
Asian Hotels (North) Limited has received an interim order from the Hon'ble High Court of Delhi concerning two connected commercial suits, in which it was found to have established a strong prima facie case. The ruling directed DBS Bank India Limited to release original title deeds and other security documents relating to the Hyatt Regency property in New Delhi, conditional upon Asian Hotels (North) depositing a specified amount with the Registrar General of the Delhi High Court.The interim applications were heard by the Hon'ble Delhi High Court concerning CS(COMM) 376/2026 (Asian Hotels North Limited v. Exclusive Capital Limited & Ors.) and CS(COMM) 1360/2025 (Exclusive Capital Limited v. Clover Media Private Limited & Ors.). The Court examined the Inter-Corporate Loan Agreement, the subsequent assignment of debt, and the One-Time Settlement (OTS).
Based on its examination, the High Court held that Asian Hotels North Limited possesses a strong prima facie case, concluding that the balance of convenience lies in its favour. The court directed DBS Bank India Limited to release the original title deeds and other security documents relating to Hyatt Regency, located at Bhikaji Cama Place, New Delhi, subject to a mandatory condition set by AHNL.
As per the Court's order received on August 5, 2026, Asian Hotels (North) Limited is required to deposit ₹1,59,66,05,228 with the Registrar General of the Delhi High Court within four weeks. This deposited amount must be held in an interest-bearing fixed deposit and remains subject to the final outcome of the suit.
Upon proof of this deposit, DBS Bank India Limited is required to release the original title deeds and security documents to AHNL within one week. The court also clarified that all observations and findings contained in the interim order are prima facie in nature and will not influence the ultimate adjudication of the suits on their merits.
The proceedings do not involve a finding of any violation or contravention by Asian Hotels (North) Limited. Although the hotel property documents are conditionally due for release, Asian Hotels confirmed that this event will not have a material financial or operational impact on the Company, as the documents relate specifically to the Hyatt Regency Hotel property.
