The Competition Commission of India (CCI) has delivered a major verdict against agricultural input associations, ruling that the coordinated boycott campaign targeting online agri-input platforms constitutes anti-competitive conduct. The ruling holds key leaders of agro-dealer organizations liable and orders all parties to cease such practices, affirming the importance of technological innovation in the agriculture sector.

CCI Rules Agro-Dealer Bodies Violated Anti-Competitive Norms​

The Commission found that the Agro Input Dealers Association (AIDA) and the Agro Input Welfare Association (AIWA) violated Section 3(3)(b) of the Competition Act, 2002. The findings established that these powerful trade associations limited the supply chain and distribution channels by actively coercing retailers and manufacturers to reject online platforms.

The investigative process concluded that the OPs' actions were more than just regulatory concerns; they constituted a deliberate attempt to control commercial decisions within the market, resulting in adverse effects on competition (AAEC).

The Mechanics of the Boycott Campaign Exposed​

The investigation revealed extensive evidence detailing the organized campaign against digital agri-input businesses. AIDA and AIWA disseminated messages and issued letters instructing members to boycott online platforms, despite regulations permitting e-commerce sales for certain products like insecticides.

For example, OP-1 issued a communication on 05.08.2022 directing companies to stop selling through online platforms, stating that cooperation would only be extended to firms dealing exclusively through offline channels. Furthermore, communications circulated by OP-2 contained a list of companies encouraging members to support the association's stand against online sales.

The Commission found that this boycott campaign successfully drove agri-input manufacturers to take positions affirming they would not enter into agreements with online e-commerce platforms. This collective effort created a dual blockade, inhibiting market access for technology-driven players like Ulink Agritech Private Limited (the Informant).

Impact and Penalties Imposed on Associated Officers​

The CCI concluded that the campaign severely impaired the growth of innovative agri-tech businesses. The Information highlighted that digital platforms provided vital benefits to farmers by enabling them to purchase products in smaller quantities, assisting small dealers who could not access bulk supplies otherwise.

In response, the Commission ordered the OPs and several senior individuals to pay a penalty calculated as 5% of their average income across relevant Financial Years (FYs). The fines reflect the gravity of the contravention committed by the associations.

  • Sanjay Kumar Raghuvanshi, National Spokesperson, AIDA: ₹8,622

Future Directions and Compliance Mandates​

The Commission has ordered the OPs and all liable individuals to cease and desist from engaging in any anti-competitive conduct in the future. They are also mandated to organize a competition compliance training programme within 60 days of receiving the order.

This ruling underscores the CCI's commitment to protecting technological innovation and fair market access in the critical agri-input sector. The Commission emphasized that legitimate regulatory concerns cannot be used as justification for practices that actively control commercial decisions or restrict supply channels, particularly when such actions are proven to hinder growth.
