A F Enterprises Ltd's CIRP Withdrawn Following Full Settlement with Financial Creditor

The Corporate Insolvency Resolution Process (CIRP) against M/s AF Enterprises Limited has been successfully withdrawn after a full and final settlement was reached with the financial creditor. The resolution process, which had commenced earlier in 2025, came to an end following approval from the National Company Law Tribunal (NCLT).

The withdrawal of the Corporate Insolvency Resolution Process (CIRP) against M/s AF Enterprises Limited was finalized after an NCLT order dated August 06, 2026. The decision followed a settlement agreement executed on July 07, 2025, between the corporate debtor and M/s Findoc Finvest Private Limited.

The settlement addressed the outstanding loan liability for a total amount of ₹3,00,00,000 (Three Crores only). The withdrawal was based on the subsequent approval by the Committee of Creditors (CoC), which comprised M/s Findoc Finvest Private Limited as the sole member holding 100% of the voting share.

Key aspects of the resolution and closure include:

  • CIRP Costs: The management of the corporate debtor has fully paid and reimbursed all CIRP costs, totaling ₹4,59,741.
  • EMD Refunds: All Earnest Money Deposits (EMDs) received from prospective resolution applicants have been refunded.
  • Debt Discharge: The parties confirmed that there were no subsisting or future claims against the Corporate Debtor as of the date of the settlement.

The CIRP process, which had led to a moratorium under Section 14 of the Code, is now terminated, and management control has reverted back to M/s AF Enterprises Limited.
